Purpose

Reading these General Terms and Conditions of Contracting ("GTC") is a necessary condition prior to finalizing the purchase of any item or product through the Mimetikbcn.com website. These GTC govern the relationship between the user (hereinafter, “the User”) and Mimètik Lovers SL (hereinafter, “Mimetikbcn.com”), located at Calle Numància 91 13 3, 08029 Barcelona, Spain, with VAT No. B67059410.

The GTC also inform you of certain important features of the services provided by Mimetikbcn.com, such as customer service, delivery services, warranties, and additional services that Mimetikbcn.com may directly or indirectly provide (collectively, “the Service”). Completing the forms available for placing an order and providing banking, credit card, or PayPal details implies full acceptance without reservation of all provisions of these GTC published on the Mimetikbcn.com website (“our Website”).

Validity of the Offer

Prices and conditions displayed on the website are valid at the time they are shown and are only applicable within the current session. Mimetikbcn.com is not responsible for changes that may occur between sessions.

Prices, Billing, and Payments

Prices and fees applicable to items are those specified in the item description, which include indirect taxes as per the rates, general and/or specific conditions, offers, or promotions available at that time and published on our Website or in other media. Shipping costs are not included in the item description, and applicable rates will depend on the destination. Payment for purchases made through Mimetikbcn.com may be completed using the following methods:

1) Credit or Debit Card Payment:

If the card information is incorrect, the purchase will not proceed. Charges are processed once the purchase details are confirmed. If payment fails, we will inform you via email. Please note that Mimetikbcn.com’s payment gateway includes security measures to prevent data interception; however, internet data transfer always carries interception risks, which Mimetikbcn.com cannot guarantee.

2) PayPal

You may also pay using your PayPal account. Your purchase will be completed under the same terms as with a card payment. If the PayPal account details do not match the buyer’s information, Mimetikbcn.com may contact the buyer to confirm their identity. Due to the high PayPal commission, a surcharge may apply, which will be disclosed before confirming the order.

Obligations of Both Parties

Mimetikbcn.com agrees to:

1. Provide complete information on each item available on the website (price, characteristics, etc.).
2. Take necessary actions to ensure the smooth processing of transactions on the website.
3. Offer post-sale support and customer service to buyers.
4. Ensure that buyers receive items in excellent condition.

The User agrees to:

1. Use the Service per the Website's Terms of Use, Privacy Policy, and these GTC.
2. Pay for items via approved methods.
3. Not misuse the website or services against good faith or in a fraudulent, malicious, or unlawful manner.
4. Ensure the accuracy of personal information provided and update it as necessary.

Order Delivery and Delivery Times

Products will be delivered via a transport agency or postal service. Delivery times vary depending on the product type and destination:

• Standard or One-size products: Production takes approximately 3 business days. Shipments take 24-48 hours within Spain, 3-5 business days within the EU, and 5-8 business days to the US.
• Custom-made products: Approximately 4 weeks.
• Accessories, short dresses, and samples: Production takes 1-3 business days, with estimated delivery times of 10 business days to the EU and 15 business days to the US.

Mimetikbcn.com is not liable for delivery failures due to the recipient’s absence or physical inability to complete delivery. Delivery costs for failed shipments and return shipping are the buyer's responsibility. Customs charges, if any, are also borne by the buyer. Estimated delivery times are listed on Mimetikbcn.com and are subject to change. Buyers will be notified of shipping updates. Mimetikbcn.com is not liable for delivery delays due to uncontrollable circumstances (e.g., severe weather, transport sector strikes, lost items). If a package shows signs of damage or tampering upon arrival, check its contents before signing for receipt. If damaged, please contact us at hello@mimetikbcn.com for return instructions.

Right of Withdrawal

If the item is a standard size or ready-to-ship, you may return or exchange it within 14 days of receipt via the portal: https://mimetikbcn.shipping-portal.com/rp/. Items must be returned in perfect condition, with original packaging and proof of purchase.

• Return shipping costs are the customer’s responsibility.
• Original shipping costs are non-refundable.
• The first exchange is free, with Mimetikbcn.com covering shipping costs for the new item.

Custom-made items cannot be returned.

Payment Terms

Payment must be made using the methods indicated in the GTC. Fraudulent credit card use or denied transactions entitle Mimetikbcn.com to cancel the order and claim damages if applicable.

Wedding Shoes Return Conditions

Wedding shoes must be returned unused and in perfect condition, ideally tested on a carpet to avoid sole damage. Items should be returned within 14 days of receipt in the original packaging. If the item or box is not returned in its original state, the buyer will be responsible for any depreciation.

Warranty

If an item is defective upon receipt or becomes damaged (not due to misuse) within 7 days, the buyer should contact Customer Service. If possible, Mimetikbcn.com will replace the item at no additional cost. Mimetikbcn.com is not liable for damages resulting from product use, including direct or indirect harm, accidents, damage to unrelated property, or lost profits.

Mimetikbcn.com provides a description of each product on its website, including intended use, materials, sizes, and colors. The user is responsible for understanding this information before purchasing.

Customer Service and Notifications

For queries or claims, please contact Customer Service as soon as possible. You may email us at hello@mimetikbcn.com. All communication related to the Service should use these contact details. Once a claim is submitted, it will be assigned a reference number, which Mimetikbcn.com will communicate to the User. If the claim is made by phone, the User may request written confirmation of the claim’s submission and content, which will be sent within 10 days. Mimetikbcn.com will inform the User of the resolution using the initial communication method.
